• Interruption of service

• Data loss or corruption

• AI system errors or inaccuracies

• Security breaches or unauthorized access

• Changes in applicable laws or regulations

- Any damages exceeding the greater of:

• The amount paid by you for the Service in the past 12 months

• $100 USD

You agree to indemnify, defend, and hold harmless WisdomPulse, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

The Service may contain links to third-party websites or services that are not owned or controlled by WisdomPulse.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You further acknowledge and agree that WisdomPulse shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We strive to maintain 99.9% service availability.

We do not guarantee:

- Uninterrupted access to the Service

- Specific response times for AI processing

- Availability of specific features or functionalities

Scheduled maintenance will be announced at least 24 hours in advance.

Emergency maintenance may be performed without notice.

Any dispute arising from these Terms will be resolved through:

1. Informal negotiation (30 days)

2. Mediation through an agreed-upon mediator

3. Binding arbitration if mediation fails

Arbitration will be conducted:

- Under JAMS Streamlined Arbitration Rules

- In English

- In the jurisdiction of our principal place of business

Class action lawsuits and class-wide arbitration are prohibited.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WisdomPulse operates, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.

We reserve the right to modify these Terms at any time with 30 days notice.

Your continued use of the Service after changes become effective constitutes acceptance of the modified terms.
